At the March 30, 2026 hearing, when the class certification was scheduled to be heard, ClubLink — supported by LENR — argued that they had no way to know whether residents other than the named plaintiffs actually support the lawsuit.
The judge did not seem to think that concern was very likely, especially given the number of residents who have already spoken up against more development.
Still, the judge asked how many supporting affidavits would make the class certification issue more comfortable to address, and the number discussed was 30. So for now, we are taking the more-is-better approach and asking as many Palm Aire owners as possible to sign the affidavit in support of the class action.
Please read the attached affidavit carefully. Once signed in front of a notary, it will be a notarized statement of support for the lawsuit, and for having the case certified as a class action so that Plaintiffs actions can resonate on behalf of the Palm Aire community.
It is not a petition, and it does not make anyone a named plaintiff. It only supports the action to move forward as a class action suit, instead of all residents being required to act as direct plaintiffs.
If you are out of town, or cannot attend signing events shared in your community, please review the affidavit and sign/notarize and return directly to the plaintiffs’ attorney to show your support.
